PROTEST POLICY FOR SPACING RELATED HEARINGS The WOGCC continues to deal with an increasing number of protested spacing related applications that are continued on a monthly basis for up to a year before any resolution occurs. This creates inefficiencies in the management of the monthly hearings and creates additional burdens on the staff. 

Therefore, starting with the July 2018 hearings, any protested spacing related application (spacing, additional wells, pooling, etc.) that is continued for a second time will be placed on an inactive docket (“B” docket) for a period of up to one year from the filing date of the second requested continuance. Once a second continuance is filed, the matter will be continued and placed on the “B” docket until the matter is either resolved by the parties or until the matter is set before the Commission at the request of either party. If the matter is not resolved within the one year period, the staff will file a request to dismiss the protest and the matter will be set before an examiner.  

Requests to remove a matter from the “B” docket and place it on the Commission’s active docket must comply with previously established WOGCC filing deadlines.
